Terms of Service & Privacy Policy
By agreeing to these terms, you agree that you understand my terms of commissioning a product from me as a freelance artist, and what I require in terms of payment and the terms of personal use vs. commercial use. This document will only be relevant as long as I am an individual freelancer, and may change if I am contracted to work with a company or other kind of group.GENERAL TERMS.Ⅰ) Don’t be vague about what you would prefer, and please provide clean, clear references for me to work off of, nothing messy or with details that are hard to make out. In terms of poses and expressions, please attempt to be as clear as possible, but I may ask for further clarification if I’m confused at all.Ⅱ) Any ill behaviour will not be tolerated and I reserve the right to cancel the commission if it occurs. Be respectful, please.Ⅲ) If you fail to follow the rules provided I have the right to cancel the commission.PAYMENT.Ⅰ) I only accept payment through PayPal. I would prefer it to be done through USD, but if you are unable to do it through USD that’s perfectly alright.Ⅱ) I do not accept payment in cryptocurrency.Ⅲ) I do not haggle. I will often be a bit lenient with what I personally think you should pay, but I will not accept price suggestions and any requests for discounts. That leniency I go through is dependent on how long I think the commission will take me-- for example, if a character has a simpler design, I will probably charge a little bit less than a more complicated one with many fine details.Ⅳ) I will require 50% of the payment up front and 50% after I have finished the piece.Ⅴ) Once the piece is finished, I will send you a watermarked preview over DM to show you that the piece has been finished. I will not send you the full image until the remaining 50% has been paid in full.Ⅵ) Social media compression isn’t always great, I will require an email of your choice to send the high res version of the image to you.Ⅶ) If you have cancelled the commission after I have sent you the initial sketch, I will be keeping half (50%) of the original payment you have already paid me, and refund you the remaining half.Ⅷ) However, if you cancel the commission before I have started on the sketch, I will refund the payment you have sent me in full.Ⅸ) Do not send payment my way until I accept the commission.Ⅹ) Extra characters will cost an extra $25, up to three characters. Once the three character limit has been exceeded, the price of the piece will be increased by x2.2.Ⅺ) If you are looking to use my art for commercial use (e.g. art for conventions, mascot designs, etc.) , the commission will be increased by 400%.Ⅻ) If you are intending to use my art for re-sale, I require an additional 10% royalty fee for every sale made.PROCESSⅠ) If you are asking for a specific pose / idea, I will first send you the initial sketch before moving on to the lineart, colouring, shading, etc. Once the sketch is complete, I will not accept any major requests for changes in terms of design, pose, or expression, and any requests for further revisions will cost an extra fee. Please consider carefully if you are happy with the sketch before I move forward.Ⅱ) The time for your commission to be completed will depend on how complicated the piece will end up being. It could take anywhere between a week to a month-- please be patient. If it’s been a while (e.g. over a week or so) and you just want to make sure I’m still working on it, it’s fine to DM me and ask how the process is going, but I will not appreciate it if you ask me every day if I’m working on it.Ⅲ) If any major issues in my life will cause the commission to be delayed by a significant amount, you will be notified. If I am further than the lineart on the commission, I will not accept any requests for refunds.USAGE POLICYⅠ) You are not allowed to use your commission to gain profit without permission and without paying an extra fee.Ⅱ) I will not permit my art to be used to promote any hateful material or events, or any sort of political message in any shape or form.Ⅲ) If you would like to use my art as your profile picture, or would like to edit them, you are fully allowed to as long as it does not promote anything listed in the part directly above and I am given full credit, with a link or mention somewhere clearly listed on your profile that I was the creator of the art.Ⅳ) However, if you intend to use my art as a way to promote your brand or website, this will also fall under commercial use and I will require that same additional fee. It is only free to use my art as a banner / icon if it is done for personal use only.Ⅴ) You are not and will never be allowed to use my art for non-fungible tokens.Ⅵ) You are not allowed to use my art for AI training / other AI-related purposes.
